The Machinery Regulation is already here. The question is: who is already acting on it?

Many companies still talk about the new Machinery Regulation as if it is future legislation.

That is not technically accurate.

Regulation (EU) 2023/1230 on machinery has already been adopted, published in the Official Journal of the European Union and entered into force. As an EU Regulation, it is directly applicable law in the European Union. It is not a draft, not a recommendation and not a Directive still waiting for national transposition.

The main application date for machinery is 20 January 2027. Until then, machinery placed on the EU market must still comply with the Machinery Directive 2006/42/EC. From 20 January 2027, the new Machinery Regulation becomes the mandatory legal framework for machinery placed on the EU market. There is no optional period in which manufacturers can freely choose between both regimes. (EUR-Lex)

For projects already in engineering, this matters now.

A machine designed, modified, integrated or substantially changed today may only be delivered, CE marked or placed on the market after the cut-off date.

Then the question is no longer only:

“Does this machine still comply with the Machinery Directive?”

The better question is:

“Are the design, risk assessment, technical documentation, control system, software, user information, digital documentation and overall safety concept already prepared for the Machinery Regulation?”

In potentially explosive atmospheres, this becomes even more important.

A machine may appear mechanically safe and still introduce an effective ignition source.
An Ex component may be correctly certified and still be incorrectly integrated.
An extraction system, dosing unit, conveyor, filter unit or packaging machine can change its risk profile through one apparently small modification.
An assembly of machinery can be safety-relevant as a whole, not just as a collection of individually CE-marked components.

This is where machinery safety and explosion protection meet.

For manufacturers and integrators, the focus is on conformity assessment, risk assessment, technical documentation, instructions, CE marking and responsibilities across the supply chain. In the EU, that route is moving from Directive 2006/42/EC to Regulation (EU) 2023/1230.

For the United Kingdom, the legal route is different. Machinery placed on the Great Britain market is still governed by the Supply of Machinery (Safety) Regulations 2008, while UKCA/UK conformity requirements and UK market rules must be considered separately from EU CE requirements. (GOV.UK)

For users and employers, CE or UKCA marking is not the end of the responsibility. Workplace use must still be assessed and controlled. In the EU this links to workplace safety duties and, where explosive atmospheres may occur, ATEX workplace requirements. In the UK, the corresponding framework includes DSEAR 2002, which requires risks from dangerous substances, fire and explosion to be assessed and controlled. HSE also links hazardous area classification and ignition source control to BS EN 60079 principles. (HSE)

The key question is therefore not only:

“Is this machine CE marked?”

The real question is:

“Is this machine, in this process, with these substances, in this environment and after this modification, still demonstrably safe?”

Machinery safety and explosion protection cannot be assessed in isolation when a machine operates in or near a potentially explosive atmosphere.

The machine must be safe as machinery.
It must not become an effective ignition source.
The integration must fit the process.
The documentation must show what has actually been assessed.

20 January 2027 may sound far away.

For live machinery projects, it is tomorrow.
